Competitours Waiver of Claims

RELEASE OF LIABILITY, WAIVER OF CLAIMS, EXPRESS ASSUMPTION OF RISK, AND PERSONAL RELEASE

Please read and be certain you understand the implications of signing

I hereby affirm and acknowledge that I have been fully informed of the inherent risks associated with engaging in a tour with Etgar Travel Services, LLC, d/b/a Competitours (“Competitours”), which may range from riding on vehicles to alpine climbing activities to cooking classes. While the specific hazards will vary, I acknowledge that they may include:

1. Risk of injury from the activity and equipment utilized, including the potential for permanent disability and death.
2. Falling, causing broken bones, severe injuries to the head, neck and back which may result in severe impairment or even death.
3. All “acts of nature,” including but not limited to avalanche, rock fall, inclement weather, thunder and lightning, severe and/or varied wind, temperature, and other weather conditions.
4. Acts, negligence, or omissions of other contestants, vendors, strangers, and other people.
5. Risks associated with transportation, including various countries.
6. Possible equipment failure and/or malfunction of my own or others’ equipment, which may have been rented, borrowed, or personally owned.
7. My own negligence and/or the negligence of others, including employees, agents, or independent contractors, or representatives of the third parties providing specific services, challenges, or adventures.
8. Attack by or encounters with reptiles, mammals, insects, or other animals.
9. Accidents or illness occurring in remote places where there are no available medical facilities.
10. Fatigue, chill, and/or dizziness, which may diminish reaction time and increase the risk of accident.
11. Sense of balance, physical coordination, and ability to follow instructions.
12. Risks associated with handling sharp knives or other cutlery.

I understand that the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death.

In consideration of being permitted to participate in Competitours’ services, I hereby release and hold harmless Competitours with respect to:

1. Any and all injury, disability, death, or loss or damage to person or property, whether caused by negligence or otherwise.
2. Any and all acts, omissions, negligence, or torts of any and all third party vendors that provide any services in connection with Competitours’ services, including any individual challenges or events.
3. Any and all choices to engage or select any activity or vendor. I expressly agree that I am fully responsible for assessing the safety of each activity or vendor for myself, based on my own physical and mental capabilities.

As part of this waiver, I release Competitours, its officers, directors, employees, representatives, agents, and volunteers (the “Releasees”), from liability and responsibility whatsoever, and for any claims or causes of action that I, my estate, heirs, survivors, executors, or my assigns have for personal injury, property damage, or wrongful death arising from the above activities, whether caused by active or passive negligence of Releasees or otherwise. I am not relying on any oral or written representation of Releasees in signing this document.

Furthermore, I irrevocably grant to Competitours, and all Releasees, the right to use my image, and name, in all forms and media including, but not limited to, still-images, video content, composite or modified representations (the “Content”) for all purposes, including, but not limited to, advertising, trade, and any commercial purpose throughout the world and in perpetuity. I waive the right to inspect or approve versions of my image used for publication, or any of the written copy that may be used in connection with the Content.

I also release Competitours, and all Releasees, from any claims that may arise regarding the use of the Content, and my image, including any claims of defamation, invasion of privacy, or infringement of moral rights, rights of publicity, or copyright. Competitours, and all Releasees, are permitted, although not obligated, to include my name as a credit in connection with any content I provide are am featured in.

I HAE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK, AND I FULLY UNDERSTAND ITS TERMS. I UNDERSTAND THAT I HAVE GIVEN UP LEGAL RIGHTS BY SIGNING IT, AND I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
